Zoning relief: variance, special/conditional use, PUD, overlay

Zoning ordinances define local procedures for variances, special or conditional uses, planned unit developments, and overlay districts. Their exact rules vary, but each addresses a different type or scale of zoning change.

Key points

  • Zoning variance:
    • A legal exception to a zoning ordinance, letting an owner use land in a way the current rule does not permit — classically a dimensional relief (e.g. building closer to the line than the setback allows).
    • Provides flexibility while keeping the overall zoning plan intact.
  • Special or conditional use permit: a locally defined approval for a use that must meet stated conditions. The available uses and approval process come from the local ordinance.
  • Planned Unit Development (PUD): a flexible, often large or mixed-use plan reviewed under local PUD standards. It requires the planning approval identified by the ordinance; nonconformance with the base use map is not a universal defining condition.
  • Overlay district:
    • Adds extra requirements or relaxes restrictions on top of existing zoning.
    • Addresses unique community concerns not covered by base zoning (e.g. a historic-district overlay with stricter architectural guidelines).
